Those rights are removed or reduced on listed buildings, in conservation areas, under Article 4 directions, on some new-build estates, and where earlier extensions have already used the allowance up.
Where the limits usually bite
Depth and height of rear extensions, eaves height near a boundary, side extension width, the volume of a loft dormer, and whether anything faces a highway are the usual constraints.
Previous extensions count towards the allowance even if you did not build them, which catches out many buyers of already-extended houses.
Lawful development certificates
If the work is permitted development, you can apply for a certificate of lawfulness confirming it. It is not compulsory, but it costs far less than a full application and gives you documentary proof.
That proof matters at sale. Without it, a buyer's solicitor has only your word that the work did not need permission.
When a full application is the better route
Where the design you actually want exceeds the limits, applying is usually better than compromising the house to squeeze under them. Kent authorities each have their own interpretations and local policies, and a pre-application conversation often saves a refusal.
We prepare and submit applications in-house alongside the drawings, so the design and the planning strategy are developed together.
Common questions
How do I know if I have permitted development rights?
Check for listing, conservation area status, Article 4 directions and any planning conditions on the original permission — new estates in particular often have rights removed.
Do previous extensions count?
Yes. The allowance applies to the original house as built, so earlier work by previous owners reduces what is left.
Is a lawful development certificate worth getting?
Yes. It is inexpensive relative to a full application and prevents disputes when you sell.
How long does a planning application take?
Householder applications have a statutory target period, though validation and consultation can extend the real timeline, so it should be started early.
